Agreement between you and us. These Terms of Service ("Terms") are a legal agreement between you and Katool Equipments ("Katool Equipments", "we", "us"), 3631 US-90, Lake City, FL 32055, United States. They apply to this website (the "Site") and to all orders placed online, by phone or by email. Our Privacy Policy, Refund Policy, Return & Refund Policy, Shipping Policy and Cancellation Policy are part of these Terms.

1. Acceptance of terms

By using the Site, creating an account or placing an order, you confirm that you have read, understood and agree to these Terms. If you do not agree, please do not use the Site or place an order.

You must be at least 18 years old and able to enter into a binding contract. If you buy for a business or organization, you confirm that you are authorized to act on its behalf. We deliver only to addresses in the 48 contiguous United States.

2. Products and pricing

Descriptions and specifications

We aim to keep product descriptions, specifications, images and capacities accurate, but manufacturers can change models, engines and features without notice. Verify compatibility, dimensions, capacity, installation requirements and intended use before you buy, and contact us if anything is unclear.

Pricing

All prices are in U.S. dollars. Prices can change at any time before you place your order. The total you pay, including any applicable taxes, is shown at checkout. Shipping to the 48 contiguous states is free.

Errors and availability

Products are subject to availability, and we may limit quantities or discontinue products. If a pricing or description error affects your order, we may contact you for instructions or cancel the affected items and refund any payment collected.

3. Orders and payment

Placing an order is an offer to buy. We confirm orders by email within one business day. We may refuse or cancel an order because of unavailability, pricing or description errors, suspected fraud or unauthorized payment. If we cancel after collecting payment, we refund the amount collected for the cancelled items.

Payment

Payment methods available at checkout, including PayPal, are processed securely by our payment providers. You agree to use a payment method you are authorized to use. Business buyers may request tax-exempt orders and Net-30 invoice terms, which are subject to approval; see Dealers & pro accounts.

Cancellations

Orders can be cancelled for a full refund before dispatch. Once an order has been dispatched it can't be cancelled and follows the return process instead. See our Cancellation Policy.

4. Shipping and delivery

Full details are in our Shipping Policy. The main terms are:

Lead times are estimates. Manufacturer backorders, weather and scheduling can extend them, and we will email you if your order is delayed more than 5 business days beyond the quoted window. Inspect the crate and machine before signing the delivery receipt, note any damage on it, and email us with photos within 48 hours of delivery.

5. Returns and warranty

Returns

Unused equipment can be returned within 30 days of delivery, in its original packaging, with a Return Authorization (RA) number. Change-of-mind returns carry the actual return freight cost and a 15% restocking fee. Damaged, wrong or defective items reported within 48 hours of delivery are returned at no cost. Warranty

Equipment is covered by the manufacturer's warranty, under the manufacturer's own terms. Machines that have been fueled, started or operated fall under that warranty rather than our return policy.

Safe use

You are responsible for installing, operating and maintaining equipment in line with the manufacturer's instructions, safety warnings and applicable codes. Use a qualified installer and a licensed electrician where required. See our installation guides.

6. Financing

Pay in 4 and Pay Monthly are offered by PayPal through PayPal Pay Later and are subject to PayPal's approval and terms. Katool Equipments is not the lender. Financing fees and interest charged by the lender are not refundable. See our Financing page.

7. Accounts and content

If you create an account, keep your login details confidential and provide accurate, current information. Tell us right away at contact@katoolequipments.com if you suspect unauthorized access.

If you submit reviews, comments, photos or other content, you confirm that you have the right to submit it and that it is truthful, and you grant Katool Equipments a non-exclusive, royalty-free, worldwide, perpetual license to use and display it in connection with the Site, subject to our Privacy Policy. You must not submit content that is unlawful, abusive, defamatory, infringing, or that misrepresents your identity or your experience with a product.

You must not use the Site for unlawful purposes, interfere with its operation or security, access systems or accounts without authorization, or introduce malicious software.

8. Intellectual property

Site content, including text, graphics, logos, images and software, belongs to Katool Equipments or to its content owners, such as manufacturers, and is protected by intellectual property laws. Brand names and logos belong to their respective owners. You may use the Site to browse, get information and buy for yourself or your business. You may not copy, distribute or commercially exploit Site content, or use our name or branding in a way that suggests an affiliation, without permission.

9. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Katool Equipments and its affiliates from claims, losses and reasonable expenses arising from your unlawful use of the Site, your breach of these Terms, or your misuse, improper installation or modification of equipment.

11. General terms

• Suspension: we may suspend or end access to the Site if you breach these Terms, act fraudulently or compromise Site security. Obligations on existing orders continue.
• Changes: we may update these Terms from time to time. Updated Terms are posted on this page with a new effective date and apply to orders placed after that date.
• Severability: if a provision is found invalid, the rest of these Terms stays in effect.
• Entire agreement: these Terms and the policies they reference are the full agreement between you and Katool Equipments about the Site and your orders.
• No waiver: not enforcing a provision does not waive our right to enforce it later.
